This charter is reviewed annually by our Independent Ethics Board — professionals with no equity in NeverPart, no employment relationship with NeverPart, and full veto authority over product decisions that affect user wellbeing. Their review is published publicly each year.
An avatar may only reflect what the person actually said, wrote, recorded, or verifiably believed. It will never be made to say something the real person would not have said. Families may not instruct the AI to misrepresent, idealize, or rewrite the person's character. The avatar is a witness — not a revision.
People are not simple. An avatar may not be used to erase a person's struggles, sanitize a difficult history, or construct a version of someone that misrepresents who they were. Equally, it may not be weaponized to amplify or fixate on their worst moments. If a family requests modifications that our ethics team determines constitute material misrepresentation of the subject's character — in either direction — we decline and flag for Independent Ethics Board review. Families who disagree with a ruling may appeal to the Ethics Board directly. The Board's decision is final.
Users under 18 may only access NeverPart through a verified parent or legal guardian account. Minor sessions run in a clinician-reviewed child mode — language, content depth, and emotional weight are calibrated by age band (under 6, 6–12, 13–17). No minor initiates an unsupervised session without per-session parental approval. Session transcripts for minor users are available to the parent account. Minor access rights are reviewed annually by our Independent Clinical Board and updated as developmental research evolves.
All uploaded content — photo, video, audio, written — is screened before ingestion using automated detection and human review. Hate speech, racism, criminal activity, exploitation, or illegal material is rejected, flagged, and where legally required, reported. Accounts violating this policy are permanently suspended. No appeal.
Authorized users may not: introduce avatar outputs into legal proceedings or estate disputes; use the avatar to influence financial decisions or beneficiary changes; record, distribute, or publish any avatar session; use the avatar to produce content damaging to the deceased's reputation; or grant access to any person not listed as an authorized family member. All sessions are logged. Violations result in immediate permanent account termination and civil legal action. Any session log subpoenaed by a court will be contested by NeverPart's legal team on behalf of the family.
No NeverPart avatar will ever appear in training data, advertising, research, or any public context — under any circumstance. Your family member's likeness, voice, and data are not an asset to us. We are a custodian, not an owner. This clause cannot be waived by any internal NeverPart decision and requires an Independent Ethics Board vote to modify.
Every avatar requires a documented, verifiable, legally reviewed consent chain. No exceptions. No workarounds. No edge cases handled informally.
A near-miss avatar is worse than no avatar. We will not release an avatar that doesn't meet our quality threshold — even if the family wants it.
Before any avatar is activated, NeverPart conducts a guided first session with a human NeverPart representative present. The family reviews the voice, the personality, and several guided conversations. The avatar is only released after explicit family approval in writing.
We maintain and publish minimum fidelity standards for voice accuracy, personality modeling, and conversational authenticity. Avatars that do not meet these thresholds are returned to refinement — not released. Families are told exactly what their avatar did and did not reach, and why.
If within 30 days of activation a family determines the avatar does not faithfully represent their loved one, they receive a full refund. All data is permanently deleted within 30 days of the refund request. No questions. No retention. Certificate of deletion provided.
NeverPart is not therapy and does not claim to be. It is a family legacy tool with hard clinical guardrails built into every session — not bolted on afterward. Our Independent Clinical Board has veto authority over any feature that affects user wellbeing.
In the first 6 months following a bereavement, NeverPart enforces a hard cap of 3 sessions per week. Users who reach 5 sessions in any 7-day window receive a mandatory 48-hour pause. At 6+ sessions in 7 days, access is suspended and a licensed grief counselor contacts them within 24 hours — not a pop-up. A human being. This ceiling is not adjustable by the user or the family.
Our AI monitors for patterns associated with complicated grief disorder — isolation language, reality displacement, refusal to engage with living relationships, session escalation. When flagged, a Clinical Board member reviews within 24 hours. The user receives direct personal outreach with a structured pathway to professional support. Avatar access is not suspended punitively — but it is paused until a licensed clinician and the user collaboratively design a healthy return-to-access cadence. This protocol was written before the product launched and is published on our site.
Any conversation containing language associated with self-harm, suicidal ideation, or acute crisis immediately suspends the avatar session, surfaces verified crisis resources, and notifies a NeverPart clinical liaison within 15 minutes. This system is non-bypassable — it cannot be disabled by the user, the account holder, or NeverPart staff. The session does not resume until a clinician has reviewed and cleared it. All crisis flags are logged and reviewed by our Clinical Board within 48 hours.

When a loved one passes, NeverPart does not immediately activate the avatar. A minimum 14-day bereavement period precedes first access — during which families receive a clinician-designed guide, grief stage resources, and a scheduled check-in call with a NeverPart clinical liaison. First access requires the family to confirm readiness, not simply click a link.
All sessions with users under 18 follow a separately designed clinical framework. Content filters, session length limits, and mandatory parental review summaries are enforced automatically — no override.
Every session ends with a prompt encouraging real-world connection with living family members. NeverPart is designed to strengthen the living family — never to substitute for it.
We made a deliberate choice: no subscriptions. No monthly fees. No one should ever lose access to a loved one because of a missed payment. You pay once — and they are yours, indefinitely.
As our technology advances, new experiences become available. If you want to upgrade — a more detailed avatar, video presence, Family Reunion — we'll offer existing families a free trial year and a meaningful discount. You're never left behind.
We are not racing to scale. Each phase is gated by quality, independent ethics review, and real family feedback. No phase opens until the previous one is demonstrably right.

Interactions may cause unexpected grief, sadness, or psychological discomfort. These reactions are normal and reflect the depth of your connection.
Intensive use in early bereavement may disrupt normal grief processes. Mandatory usage limits and clinical monitoring reduce — but cannot eliminate — this risk.
Some users may develop reliance on the AI presence. Session frequency limits and mandatory clinical outreach are in place to address this if it occurs.
Some users — particularly children — may experience difficulty distinguishing the AI presence from the actual person. Clinical monitoring is designed to detect and respond to this.
The AI may generate responses that feel wrong or hurtful. Our 30-day integrity guarantee and quality thresholds address this — but no technology guarantees perfect fidelity.
No digital system guarantees absolute security. In the event of a breach, you will be notified within 72 hours and provided 24 months of identity monitoring at no cost.
The following protections are mandatory, non-negotiable, and cannot be disabled by anyone — including you.

Our Clinical Board holds no NeverPart equity. They have documented veto authority over any product decision affecting user wellbeing. Their annual review is published publicly, regardless of findings.

These prohibitions are absolute. Violation results in immediate permanent account termination and may result in civil legal action. Each must be acknowledged individually.
